Divorcing in Kentucky: Get Prepared
Divorcing is not something most people want to do. They may feel that they’ve let down their spouse or that they’ve let themselves down because of not wanting to stay in the relationship. Still, if your marriage isn’t working out the way you’d hoped, divorce could be the right answer.
Getting a divorce isn’t particularly difficult, but it can be complex. When you file, you’ll want to make sure that you have copies of important documents prepared for your attorney. Some of the documents you’ll want to have on hand include:
Financial documents, like copies of your bank account statements
Tax documents from previous years
Photographs of high-value assets in the home
Text messages or documentation to support claims you may be making against your spouse
No one’s divorce is the same. That’s why it’s important for you to gather as much information as you can for your attorney. Your attorney will then review the case and your information with you so that you can understand what you need to do to be prepared.
If you file first, your spouse will be served the divorce paperwork. They have time to respond to it. You won’t need to prove fault in Kentucky. You do, however, need to separate for at least 60 days before you will be able to file your final paperwork. This is part of the separation period required of most couples, especially if there are children involved. If you have questions about the separation period or what comes next once you file, your attorney will be able to tell you more and keep you updated on what to expect as your divorce progresses through the court.
